USA Choice Policy Statements

With the exception of the Contract Accounts, if you find any policy change/s unacceptable you have the right to cancel your service. However, if you continue to receive service after the effective date of the change, we will consider this as acceptance of the change.

USA Choice Internet Services, LLC complies with all state and local laws and ordinances.

Loud, abusive or profane language will NOT BE TOLERATED!

Any customer who leaves a voice mail message, talks to our employees in the above manner or uses profane or abusive language in an email message will be subject to immediate cancellation without benefit of any refund for unused service.

Abuse of our personnel will NOT BE TOLERATED.

Privacy Policy

Your privacy is very important to us. We want to make your experience on the Internet as enjoyable and rewarding as possible, and we want you to use the Internet’s vast array of information, tools, and opportunities with complete confidence. We have created this Privacy Policy to demonstrate our firm commitment to privacy and security.

  • Responses to Email Inquiries: When Visitors or Members send email inquiries to USA Choice Internet, the return email address is used to answer the email inquiry we receive. USA Choice Internet does not use the return email address for any other purpose and does not share the return email address with any third party.

  • Public Forums: Please remember that any information you may disclose in our Member Directory, or other public areas of our Web sites or the Internet, becomes public information. You should exercise caution when deciding to disclose personal information in these public areas.

  • Online Shopping: At some Web sites, you can purchase products and services or register to receive materials, such as a catalog or new product and service updates. In many cases, you may be asked to provide contact information, such as your name, address, email address, phone number, and credit/debit card information. If you complete an order for someone else, such as an online gift order sent directly to a recipient, you may be asked to provide information about the recipient, such as the recipient’s name, address, and phone number. USA Choice Internet has no control over the third parties’ use of any personal information you provide when placing such an order. Please exercise care when doing so.

  • Disclosure: We do not use or disclose information about your individual visits to USA Choice Internet or information that you may give us on USA Choice Internet, such as your name, address, email address or telephone number, to any outside companies. USA Choice Internet may share such information in response to legal processes, such as a court order or subpoena, or in special cases such as a physical threat to you or others.

Toll Free number verification

It is your sole responsibility to verify that the internet access telephone number given to you is a local number. If it is not a local number, please contact USA Choice Internet Services immediately and a new access number will be provided to you , which again, will be subject to verification of its local status by you.

USA Choice Internet Services, LLC shall not be responsible for any toll or long distance telephone charges incurred by you, the subscriber.

Use of cell phones for technical support

If a customer calls technical support using their cell phone or leaves their cell phone number as a call back number, the customer, NOT USA Choice, is responsible for any additional charges on their cell phone bill. Also, if a customer requests that a USA Choice employee call them on their cell phone, the customer, NOT USA Choice, is responsible for any additional charges on their cell phone bill. No exceptions.

Failure to make Payment

If you fail to pay by the due date you are in breach of contract and all remaining months left on the contract will become due and payable immediately. Failure to bring your account current may result in the reporting of your account to a collection agency or credit bureau or both.

If your service is disconnected for failure to pay the invoice by the due date, your account will NOT be credited for the time that it was on hold for non-payment and we may require you to pay all past-due charges, a reconnect fee and a minimum of one month's advance charges before we reconnect your service.

Returned Check Policy

There will be a $25.00 charge for returned checks.

Multiple users of an account

Multiple usage of a single dial-up account will not be allowed. This is tantamount to stealing internet service. When we detect multiple usage, we will place the account on HOLD. The registered owner of the account must call us, at which time we will require him/her to change the password for the account. A $25 reconnect fee will be also be assessed. The account will not be reactivated until the password is changed and the reconnect fee is paid.

Account Renewal

Accounts are automatically renewed unless cancelled by the customer prior to the end of the current month. Customers may request cancellation of their account up to 6 months prior to the requested cancellation date. Accounts which are set to close at the end of the month will be closed the morning of the last business day of the month. This is done to prevent further charges from being applied to the account.

Any accounts that are in arrears on payment will be placed on "Unpaid Hold" without written notice and will be subject to collections. This may also result in the application of a $25.00 reconnect fee. Months of service are not prorated for any reason.

The account username and password must be provided and, in the case of written cancellations, the account owner's name and address must be included. ALL cancellations must be initiated by the account owner only unless the owner is incapacitated in which case the cancellation can be accomplished by a person with a power-of-attorney for the owner. Cancellations received from persons other than those described above will not be honored. A ticket number can be provided as confirmation of phone cancellations upon request.

Refund Policy

No refund of money paid in advance will be made in the event of cancellation or when a switch to a different internet service provider is made. This includes payments made by cash, check, money order and credit card.

Credit Card Payment Policy

Customers choosing to pay by credit card agree that USA Choice will charge their credit card automatically when each future payment is due without notice to the customer of such charge. This will continue until and unless the billing department is notified otherwise. Notification must be received prior to the first of the month for which the amount is due.

Limited Responsibility

USA Choice is not responsible for problems with your individual computer equipment and peripherals, software purchased elsewhere or downloaded from the Internet, and/or the phone line quality at your location.

Policy governing the use of personal web space

Customers of USA Choice Internet Services, LLC have available to them up to 2 MB of disk space for use as a personal, non-commercial web site. This space cannot be used for commercial, pornographic or any objectionable material. What is objectionable will be determined solely by USA Choice Internet Services management. If you are deemed to be in violation of this policy, your space will be deleted and you may, at our discretion, have your account terminated.

Warranty

User expressly agrees that the use of USA Choice and the Internet are at members' sole risk. Internet access is provided "AS IS" and "AS AVAILABLE" for your personal use, without warranties of any kind, either expressed or implied. USA Choice provides Internet service on a commercially reasonable basis and does not guarantee that members will be able to access the service at a time or location of their choosing, or that it will have adequate capacity for the service as a whole or for particular products.

You understand that the cumulative liability of USA Choice for any/all claims relating to the services provided, in contract, tort, or otherwise, shall not exceed the amount paid for services rendered.

These terms and conditions reflect the entire agreement of the parties and supersede all prior oral and written agreements and understandings of the parties.

Email Terms of Use

It is NOT permissible to send threatening, harassing, pornographic or SPAM email using your USA Choice, Keystone, Groundhog or TCIS email account. Anyone violating these terms of use will have their account terminated immediately without notice and without any refund of paid up, unused service. Any violation of federal, state or local laws will be reported to the appropriate authorities.

SPAM is defined as unsolicited, bulk mailings.

Open Internet Policy Statement

Policies Preserving the Open Internet

USA Choice Internet Services Company, LLC, and its affiliates (collectively, “USA Choice”), are committed to providing fixed broadband Internet access (the Service) in a manner that fosters an open and robust public Internet and that complies with the Open Internet Rules adopted by the Federal Communications Commissions (FCC). Subject to reasonable network management practices, in providing the Service, USA Choice will not: (1) block lawful content, applications, or services; (2) block or restrict end users from connecting and using any lawful device of their choosing (provided such device does not harm the network, and conforms to widely accepted and publicly-available standards applicable to the service); or, (3) unreasonably discriminate in transmitting lawful network traffic.

Network Management

Like other Internet service providers, USA Choice manages its network to protect the security, integrity, and reliability of the network, such as to address spam, viruses, and malicious content. To do so, USA Choice uses generally accepted industry standard tools. USA Choice does not modify the protocols of these industry standard tools. We block industry standard known ports used for spamming and malicious use. We also comply with applicable law, including laws for the protection of children online and the protection of intellectual property.

Although our network provides substantial capacity, it is not unlimited, and at times of high use, the network may experience congestion. USA Choice reserves the right to prioritize traffic based on real time and non-real time applications during heavy congestion periods based on generally accepted technical standards and measures.

Network Performance

USA Choice provides the Service over wired and wireless networks. Information about the typical speed ranges and latency (i.e., the time for a signal to get there and back) that customers can expect when using the Service is available at http://www.usachoice.net.

The mean upload speed during “busy hours” between 7:00pm and 11:00pm and week nights is 1Mbps and the mean download speed is 2Mbps. The mean latency during this period is 150ms.
